Ola Loa LLC (Ola Loa Swim Academy, Ola Loa Swim OLS)
By enrolling your child or dependent in our classes, you represent and warrant to Ola Loa LLC:
You are the legal parent/guardian of the child/ward or are duly authorized by the legal parent/guardian of the child/dependent to enroll the child/dependent in our classes.
You have the capacity and power to enter into, exercise your rights, and perform and comply with your obligations under these T&Cs, and to procure the same of your child or dependent.
Course fees for group or Private lessons vary for each program, as indicated on the website. For specific details, please contact us directly. All fees must be paid in advance of the start date of a course. Swimmers will not be allowed to participate in any swimming lessons until the fees are paid in full. Fees may be paid following the terms as discussed with the office. Any bank charges we receive for returned payments will be charged at a rate of $25.00. There is a one-time registration fee of $10.
Once you sign up, you will be charged according to the payment terms of the program selected. If you choose to cancel your program, your deposit and any lessons completed will not be refunded. After the initial deposit is collected you will be charged weekly for lessons.
We do not offer refunds or cancellations for change of mind or vacations. Medically required cancellations or rescheduling are assessed on a case-by-case basis.
When you book your program, we book our time, rent the pool, and remove the opportunity for another ohana to become water-safe at that time. Ola Loa LLC does Offer Make-up Lessons if there is availability in the schedule.
Make up lessons must be used within 21 days, otherwise they expire. If there is no empty spots to makeup your lesson in that lesson will be forfeited. Kids get sick, we try to offer a bit of flexibility when booking lessons with us. We have kids and know that as much as we love keeping a schedule, things change daily. We allow each student 3 cancellations a quarter.
Programs: If you wish to cancel a booking, you may do so by contacting us in writing at any time before your first lesson. Your deposit will be forfeited; however, you will receive a refund of tuition fees paid less a 20% administration charge for any future payments made.
However, we cannot provide credits or refunds if you are unable to attend any of the lessons for any reason without proper notice.
Group Class Swimming lessons: Unfortunately, we do not provide any refunds for these lessons.
Medical Conditions and Individual Needs
By enrolling your child or ward in classes, you represent that your child or ward does not suffer from any disability, condition, or illness that will in any way affect his/her ability to swim.
Parents/Guardians must declare any disability, condition, or illness affecting their child/dependent to Ola Loa LLC, regardless of the severity of such disability, condition, or illness. Such declaration must be made prior to enrollment, or if the disability, condition, or illness arises after enrollment, immediately upon its discovery. Such declaration must be in writing.
After carefully reviewing your declaration, we will decide, in our absolute discretion, whether your child or ward is capable of undergoing swimming classes at Ola Loa LLC.
Parents/Guardians are responsible for ensuring that their child or ward is medically fit to swim and undergo physical activities.
Valuables
Ola Loa LLC will not accept liability for the loss of or damage to any personal effects brought to any session, and you are therefore requested to ensure that no valuable items are brought to the swimming lessons.
Swimmers, parents, guardians, siblings, or all other associates must observe the venue's entry rules and respect all other venue rules while in the venue. Staff shall retain the right to refuse admission.
Parents/Guardians must supervise their child at all times. This duty includes ensuring that their child or ward is in their direct line of sight and that younger children are within an arm's length reach when in the pool. Parents/Guardians should keep watch of their child before, during, and after classes, regardless of whether their child is in or out of the pool. For parent-assisted classes, the guardian in the pool must be at least 18 years old.
